1. Acceptance of Terms

By accessing or using Outpace-AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Outpace-AI provides AI-powered cold email generation and optimization tools for B2B sales teams. The Service includes email fine-tuning, AI-generated outreach, signal-based lead capture, and related features.

3. User Responsibilities

Email Compliance

You are solely responsible for the content of emails sent through Outpace. You agree to:

  • Comply with the CAN-SPAM Act and all applicable email marketing laws
  • Include accurate sender information and a valid physical address in all commercial emails
  • Honor opt-out/unsubscribe requests within 10 business days
  • Not use the Service to send deceptive, misleading, or fraudulent emails
  • Not send emails to purchased or scraped lists without proper consent

Account Security

You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. CAN-SPAM Act Compliance

Outpace-AI is designed to help you comply with the CAN-SPAM Act. We provide:

  • Automatic unsubscribe link management
  • Sender identity verification
  • Opt-out processing tools

However, ultimate responsibility for CAN-SPAM compliance rests with you, the user. Outpace-AI is not liable for any violations arising from your use of the Service.

5. Intellectual Property

You retain ownership of all emails and content you upload. AI models fine-tuned on your data are for your exclusive use — we do not share your fine-tuned models or training data with other customers.

6. Payment & Billing

  • All plans are billed monthly or annually in advance
  • 14-day money-back guarantee on all plans — if you're not satisfied within the first 14 days, we'll issue a full refund
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • Prices may change with 30 days' notice; existing subscribers are grandfathered at their current rate for 12 months

7. Limitation of Liability

To the maximum extent permitted by law, Outpace-AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

8. Termination

We may suspend or terminate your account if you violate these Terms, including CAN-SPAM violations. Upon termination, your data will be deleted within 30 days unless retention is required by law.

9. Indemnification

You agree to indemnify and hold harmless Outpace-AI from any claims, damages, or expenses arising from your use of the Service, including any CAN-SPAM violations or email content you generate.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days in advance.
